Related Services Procedure

HB 1279 Related Services

Bold City Education | San Jose Primary • San Jose Prep
Effective: 2026–27 School Year

Purpose

Establish a consistent process for identifying missed IEP-related services, notifying parents, planning and tracking make-up services, and responding to requests for service-provider logs or progress notes.

Legal Anchor

Florida Statutes §1003.5716(5): When a related service identified in an IEP is not provided as scheduled, the district must notify the parent/guardian in writing or electronically within 10 school days, explain why it was not provided, and discuss a plan for make-up services.

Parents/guardians also have the right, upon request, to access all service-provider logs or progress notes within 15 school days after the service is provided. Parents must be informed of this right at each IEP meeting.

Internal Bold City target: Missed services are reported within 1 school day, and parent notice is prepared/sent within 5 school days whenever practicable. The statutory outside limit remains 10 school days.

Scope

This procedure applies to related services identified in a student’s current IEP, including services such as speech-language, occupational therapy, physical therapy, counseling, and other related services documented in the IEP.

Roles and Responsibilities

Service Provider
Maintains contemporaneous service logs; flags any service not provided as scheduled; provides the reason and proposed make-up information.

ESE Designee/Case Manager
Verifies the IEP requirement; enters the missed service on the campus tracker; coordinates parent notice and make-up plan; closes the item when completed.

Campus Administrator
Monitors deadlines and unresolved items; removes operational barriers; escalates repeated or systemic missed services.

Principal/Executive Designee
Reviews compliance trends and unresolved items across campuses.

Service Delivery and Follow-Up Procedure

Step 1: Document Service Delivery

Providers document each scheduled service on the date of service, including student, service type, scheduled date, minutes/frequency, delivery status, and notes appropriate to the service record.

Step 2: Flag a Missed Scheduled Service

If a related service identified in the IEP is not provided as scheduled, the provider records the missed service and reason and reports it to the campus ESE designee within 1 school day.

Do not wait until the end of the week or month.

Step 3: Verify and Open a Compliance Item

The ESE designee verifies the student’s current IEP, confirms the service was scheduled, records the item on the HB 1279 tracker, calculates the 10-school-day statutory deadline, and assigns responsibility for follow-up.

Step 4: Parent/Guardian Notice

The school sends written or electronic notice within 10 school days of the missed scheduled service. The notice:

  • Identifies the missed service/date.

  • Explains why the service was not provided.

  • Discusses the plan for make-up services.

Bold City will target 5 school days whenever practicable.

Step 5: Make-Up Plan and Completion

The ESE designee and provider determine an appropriate make-up plan based on the IEP service and circumstances.

The plan is tracked until the service is delivered or otherwise resolved through the appropriate IEP process. Completion date and minutes are entered on the tracker.

Step 6: Parent Requests for Logs/Progress Notes

Requests for service-provider logs or progress notes are immediately date-stamped and routed to the ESE designee.

The school coordinates access consistent with §1003.5716(5)(b) and applicable student-record requirements. The request, response date, and records provided are documented.

Step 7: IEP Meeting Requirement

At every IEP meeting, the team informs the parent/guardian of the right to request access to all service-provider logs or progress notes within the statutory framework.

The meeting checklist should document that this information was provided.

Step 8: Monitoring

Campus ESE designees review the tracker at least weekly for open items. Campus administration reviews unresolved or repeat issues monthly.

Patterns involving staffing, scheduling, or vendor capacity are escalated for corrective action.

Decision Rules

  • Preserve the record. Do not delete or overwrite a missed-service entry after it is opened; document the resolution.

  • Document missed services regardless of the reason. A provider absence, testing event, school activity, scheduling conflict, or other reason does not eliminate the need to document a related service that was not provided as scheduled.

  • Document student absence or refusal accurately. The ESE designee should determine the appropriate parent communication and follow-up based on the actual circumstances and district/ESE guidance.

  • Escalate repeated missed services. Repeated missed services for the same student or service should be escalated to administration and the ESE team for review.

  • Maintain individualized decision-making. This process is a compliance workflow; it does not replace individualized IEP-team decision-making or legal advice.
